Your privacy matters to us. This Privacy Policy describes how we collect, use and safeguard your personal information when you interact with The Loan Solution. We are fully compliant with the Information Technology Act, 2000, SPDI Rules 2011 and the Digital Personal Data Protection Act, 2023.

1. Introduction

The Loan Solution ("we", "our", "us", or the "Company") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, store and safeguard your data when you visit our website www.theloansolution.in, use our mobile applications or interact with our services (collectively, the "Platform").

This Policy is published in compliance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules"), and the Digital Personal Data Protection Act, 2023 ("DPDP Act").

By using our Platform, you consent to the collection, use and disclosure of your information as described in this Policy.

2. Information We Collect

We may collect the following categories of personal information when you use our Platform:

(a) Personal Identifiers: Full name, date of birth, gender, marital status, photograph.

(b) Contact Information: Email address, mobile number, residential and office address, city, PIN code.

(c) Financial Information: PAN, Aadhaar (last 4 digits only for OTP authentication), bank account details, salary slips, bank statements, ITR, Form 16, GST registration, business turnover.

(d) Loan / Insurance / Investment Information: Loan amount required, tenure, purpose, existing loans, credit-card details, insurance cover required, investment goals.

(e) Credit Bureau Data: CIBIL/Experian/Equifax/CRIF Highmark score and report (only with your explicit consent).

(f) Device & Usage Data: IP address, browser type, operating system, device identifiers, pages visited, time spent, referring URLs, cookies and similar tracking technologies.

(g) Communication Records: Call recordings (for quality and training), email exchanges, WhatsApp/SMS conversations, chatbot transcripts.

3. How We Collect Information

We collect information directly from you (when you fill out a lead form, apply for a loan, request a CIBIL check or contact us) and automatically through cookies, analytics tools (such as Google Analytics 4 and Meta Pixel) and our partner integrations.

We may also receive information from our Partner Institutions (banks, NBFCs, insurance companies) regarding the status of your application, disbursement or claim.

4. Purpose & Use of Information

We use your personal information for the following lawful purposes:

(a) To verify your identity and assess your eligibility for loans, insurance and investment products.

(b) To match you with the most suitable Partner Institution and submit your application.

(c) To check your credit score (only with your explicit consent) via credit bureaus.

(d) To communicate with you regarding your application, account, offers, status updates and customer support.

(e) To send promotional, marketing and educational content (only if you have opted in — you may opt out anytime).

(f) To comply with legal, regulatory, tax and accounting obligations.

(g) To detect, prevent and investigate fraud, identity theft and unauthorised transactions.

(h) To improve our Platform, services, content and user experience through analytics.

5. Disclosure of Information

We may share your information with:

(a) Partner Institutions: Banks, NBFCs, insurance companies and asset management companies whose products you have expressed interest in, for the purpose of processing your application.

(b) Credit Bureaus: CIBIL TransUnion, Experian, Equifax and CRIF Highmark, for the purpose of obtaining your credit report (only with your consent).

(c) Service Providers: Third-party vendors who help us run our business (such as cloud hosting providers, email/SMS gateways, CRM systems like Zoho, analytics tools, payment processors), under strict confidentiality and data-protection contracts.

(d) Regulatory & Law Enforcement: Government authorities, courts, regulators (RBI, SEBI, IRDAI), law-enforcement agencies and tax authorities, where required by law or to protect our legal rights.

(e) Business Transfers: In connection with any merger, acquisition, restructuring or sale of all or part of our business assets.

We do NOT sell, rent or trade your personal information to any third party for their own marketing purposes.

6. Cookies & Tracking

We use cookies, web beacons, pixel tags and similar technologies to (a) keep you signed in, (b) remember your preferences, (c) measure traffic and performance, and (d) deliver relevant ads on third-party platforms.

You can control or disable cookies via your browser settings. However, disabling certain cookies may impact the functionality of our Platform.

We also use Google Analytics 4 and Meta (Facebook) Pixel. These tools may collect anonymised behavioural data and combine it with other data they hold. You may opt out of Google Analytics here: tools.google.com/dlpage/gaoptout.

7. Data Security

We implement industry-standard administrative, physical and technical safeguards to protect your information against unauthorised access, alteration, disclosure or destruction. These include:

(b) Encrypted database storage with role-based access controls.

(c) Regular vulnerability scans, penetration testing and security audits.

(d) Strict need-to-know access for our employees and contractors, governed by confidentiality agreements.

However, no method of internet transmission or electronic storage is 100% secure. We cannot guarantee absolute security, but we work continuously to enhance our defences.

8. Data Retention

We retain your personal information for as long as necessary to fulfil the purposes outlined in this Policy, or as required by applicable law (typically 7-10 years for financial records, in compliance with RBI, Income Tax Act and PMLA requirements).

Once the retention period expires, we will securely delete or anonymise your information.

Subject to applicable law (including the DPDP Act, 2023), you have the following rights regarding your personal information:

(a) Right to Access: Request a copy of the personal information we hold about you.

(b) Right to Correction: Request correction of inaccurate or incomplete data.

(c) Right to Erasure: Request deletion of your data (subject to legal-retention obligations).

(d) Right to Withdraw Consent: Withdraw consent for processing at any time. This will not affect the lawfulness of processing carried out before the withdrawal.

(e) Right to Opt-Out of Marketing: Unsubscribe from promotional emails by clicking the unsubscribe link in any email, or by writing to privacy@theloansolution.in.

(f) Right to Grievance Redressal: Lodge a complaint with our Grievance Officer (details below) or with the Data Protection Board of India.

To exercise any of these rights, please write to privacy@theloansolution.in with sufficient proof of identity. We will respond within 30 days.

10. Children's Privacy

Our Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from minors. If we discover that we have inadvertently collected such information, we will delete it promptly.

11. International Data Transfers

Your data is primarily stored on servers located in India. In limited cases (e.g., cloud-hosted analytics, CRM or email infrastructure provided by global vendors such as Google, Microsoft or Zoho), your data may be transferred to and processed in other countries. We ensure that such transfers comply with applicable law and that adequate protection is in place.

12. Third-Party Links

Our Platform may contain links to third-party websites (banks, NBFCs, payment gateways). This Privacy Policy does not apply to those websites. We encourage you to read their privacy policies before sharing any personal information.

13. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements or other factors. Any changes will be posted on this page with an updated "Last Updated" date. We encourage you to review this Policy periodically.
